General Condition of Sale

Article 1: Application and acceptance

The following terms and conditions apply to all orders placed with Scratch/My/Back or directly with WILLIG Nicolas.

When placing an order you declare to accept the entirety of these Terms and Conditions of Sale fully and without reservation. Data recorded by Scratch/My/Back
constitute proof of all transactions made by Scratch/My/Back and its customers.

Article 2: Prices

2.1 The prices of our products are quoted in Euro Excluding VAT (excluding VAT) and excluding processing and shipping costs and subject to variations without notice.
VAT not applicable, art. 293-B of the CGI.

2.2 Scratch/My/Back reserves the right to modify its prices at any time and the products will be invoiced on the basis of the price in force at the time of the recording of the orders.
However, prices can not be guaranteed beyond 7 days for orders paid by check.

Article 3: Payments

The payment of orders is carried out by:
– bank check issued by a bank domiciled in metropolitan France, made out to “WILLIG Nicolas scratch my back” and sent to the following address: 7 rue de l’Europe 68500 BERGHOLTZ.
– bank transfer with a RIB on request and sent by email.
– Bank Card via the Stripe payment service.

Article 4: Products

4.1 The products distributed by Scratch/My/Back are stand for attaching the pedal effects to the pedalboards consists of a plate of aluminum and Velcro (supplied with screws according to the models).

4.2 Scratch/My/Back or WILLIG Nicolas can not be held responsible for:
– When mounting the products on the customer’s equipment, a deterioration of the product or its pedal effect is noted.
– When mounting the products on the customer’s equipment, the equipment loses its warranty period.

Article 5: Orders

5.1 Orders are received by email or via the online store.

5.2 Orders are accepted within the limits of available stocks. Information on availability and shipping times of items, are indicative
and in no way constitute a contractual commitment.

5.3 Scratch/My/Back will communicate by email the confirmation of the recorded order.

Article 6: The expedition

6.1 The products will be delivered to the address indicated in the order. It is up to the customer to check the contact information he provides in the order mail or on the website.

6.2 The products are delivered in letter format not followed or followed according to the request of the customer during the order.
A tracking package can also be considered on a large order at the request of the customer.
Shipping costs are entirely the responsibility of the customer.

6.3 In the case of a lost letter or package if the tracking option has not been taken by the customer when ordering no refund or purchase order or exchange or return can be considered.

6.4 It is the customer’s responsibility to check the condition of the letter and parcel on delivery. In the presence of an apparent anomaly of the packaging, it is the responsibility of the customer to put reservations to the carrier.
In case of problem, if the legal reserves have not been put, Scratch My back or WILLIG Nicolas can not be held responsible for any problem of the ordered products.

6.5 Shipping costs are announced by mail (with and without tracking option) or on the online store. The order implies acceptance of these costs which are entirely the responsibility of the customer.

Article 7: Transfer of ownership

The products subject of the order remain the property of the seller until full payment thereof.

Article 8: Return

Buyers benefit from a withdrawal period (14 days imposed by law) from the delivery of their order to return the product for exchange or refund without penalty.

The date of receipt of the delivered product is evidence of the 14-day period. The return costs are the responsibility of the customer. The product (s) must be sent with tracking.

The return of the products must be accompanied by all the accessories (screws and others) and instructions provided during the delivery of the product. Items returned incomplete, damaged, damaged, used or soiled can not be returned, and will be returned at the customer’s expense.

The refunds of the products will be carried out, in a time less than or equal to 30 days after the actual reception of the parcel by our care. The customer will be refunded the full price of the product (s) presented when ordering. The return costs remain at his expense.

The refund will be made at the option of Scratch my back by bank transfer to the customer’s bank account or by check sent to the customer’s name and billing address

Article 9: Guarantee

Scratch my back guarantee these products over a period of 12 months.
The customer returns, at his expense and with tracking, the defective item and Scratch my back repairs or replaces and returns to the customer and his charge with tracking the products.

To be able to benefit from the guarantee of the products it is imperative to keep the invoice of purchase of the product.

The guarantees do not cover:
– Abnormal or improper use of products.
– Normal wear (It should be noted for example that a visual change of the surface can happen according to certain conditions, the product being made of raw aluminum)
– Defects and their consequences related to the non-conforming use for which the product is intended.
– Damage resulting from a cause external to the device (for example, accident, temperature deviations and / or hydrometry …).

Article 10: Personal Data

Scratch My Back is strongly committed not to disclose to third parties the information provided by the customer.

Article 11: Disputes
In case of dispute the court of Colmar (FRANCE) is the only competent.
